Photovoltaic Panels (First Solar/Schott), California - MultiplePosted 03/30/2011The California Construction Authority is soliciting sealed bids, subject to the General Conditions on the reverse side, on photovoltaic panels and miscellaneous material as identified below. These bids will be accepted until April 14, 2011 at 2:00 p.m. A bid deposit, in the form of a check or money order made payable to the California Construction Authority in the amount of ten (10) percent of the total bid, must accompany the bid. The bid may be hand delivered, mailed or overnight delivered to our office. This deposit will be forfeited to the California Construction Authority if the bidder fails to comply with the terms of this bid as herein set forth. This property may be inspected by contacting the below point of contact between the hours of 9:00 a.m. and 4:00 p.m., Monday through Friday. Property must be removed by the successful bidder within fifteen (15) calendar days after notice of award, time to be computed from date of mailing. The right is reserved to reject any and all bids or any part of a bid, to waive any technicality in bids, unless otherwise specified by the Authority or the bidder, and to accept any item in the bid. In case of error in the extension of prices in the bid, the unit price will govern. When equal bids are received, other factors of the sale may be considered that would make one offer more advantageous to the Authority or award will be made by lot. 2. Telegraphic, email and fax bids will not be considered unless called for in the invitation. 3. All property listed herein is offered “as is” and “where is” without warranty or guaranty as to quality, character, condition, weight, size, or kind, and no claim will be considered for allowance or adjustment based upon failure of the property to correspond with the standard expected. Bidders are therefore cautioned to inspect the property prior to submitting bid, as failure to inspect will not constitute grounds for relief or for the withdrawal of a bid after opening date. 4. Deposits from unsuccessful bidders will be refunded promptly. The deposit from a successful bidder will be held as security for the completion of the contract. If the bidder(s) fails to comply with the contract as specified, the deposit will be forfeited to the Authority as liquidated damages. 5. The bidder agrees that, if his/her bid is accepted, he/she will make full payment for and remove the property at his/her own expense within the time specified; and that the property shall not be removed until authorization is issued by the Authority after payment in full is received. The bidder further agrees to reimburse the Authority for any damages to property caused by his/her removal operations. It is also expressly understood that the property shall be held at the sole risk of the purchaser and that the State shall not be responsible, after bids are opened and award made to successful bidder, for any storage charges or for loss of the property or damage thereto by fire, theft, or other cause. 6. A Notice of Award will be mailed upon receipt of payment in full. The successful bidder will have fifteen (15) business days from the date of the notice to remove all items. If the successful bidder fails to make payment or fails to remove items within the times specified, the State reserves the right to sell or otherwise dispose of the items. If the property is resold by the original purchaser prior to the expiration of the time allotted for removal, the original purchaser will in no way be released from full compliance with the terms and conditions of the sale. 7. All controversies concerning questions of fact arising under this contract shall be decided by the Executive Officer. The bidder may appeal these decisions by submitting a written request within fifteen (15) days, to the California Construction Authority Board of Directors whose decisions shall be final and conclusive. SPECIAL INSTRUCTIONS Envelopes containing bids must be sealed. Name and address of bidder must be stated on outside of envelope. BID MUST INCLUDE CHECK OR MONEY ORDER
